On Wednesday night, Dec. 19, the Londonderry Zoning Board of Adjustments will hear a request from Unity NH, LLC with an appeal of a decision made by Londonderry Code Enforcement.
The case will be an appeal of an administrative decision from the Code Enforcement’s determination that the use at 51 Harvey Road is a sexually orientated business/sexual encounter center at 51 Harvey Road.
Another request that evening will be for a variance from Londonderry Zoning Ordinance 2.2 Table of Uses to allow a Community Center or Sexually Orientated Business.
According to the public notice, Unity’s applicant will be (name removed by request), and the owner of the facility is the Bicchieri Family Revocable Trust.
The building currently houses the establishment in the the industrial area of Londonderry near the Manchester Airport.
According to the businesses website, Unity is a LGBTQ and Alternative Lifestyle Community Center which is very discreet, fully stocked, and meticulously maintained.
The site also states, Unity’s goal is to create a welcoming community center in the heart of New England, open to those new and experienced in the Alternative Lifestyle to come together and express themselves in an as appropriate environment as possible. All events at Unity NH LLC are 21+ and IDs are checked upon admittance to the community center.
According to the town’s zoning codes there are location restrictions of Sexually Oriented Businesses as defined in Section 2, which shall be subject to all regulations, requirements, and restrictions for the zone in which the Sexually Oriented Businesses are permitted and shall be subject to the following distance requirements:
A. No Sexually Oriented Business shall be permitted within 1,000 feet of another Sexually Oriented Business which is either existing at the effective date of his article or one for which a building permit has been applied for, and no Sexually Oriented Business shall be permitted within a building, premises, structure or any other facility that contains another Sexually Oriented Business.
1. No Sexually Oriented business shall be permitted within 500 feet of any:
a. Residentially zoned land (AR-I and R-III)
b. Commercial III (office) zoned land;
c. Church, place of worship, parish house, convent, public or parochial or private school; kindergarten, state approved day care center, public sports or recreation park;
d. Town boundary line.
According to the public notice, there are five cases being heard that evening with Unity NH, LLC being heard in two of them. The meeting is scheduled to begin at 7 p.m.
